Platform usage terms and conditions

01 // ACCEPT
By accessing or using the Boise Gun Club website ("boisegunclub.com"), mobile applications, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Platform.
The Platform is operated by Boise Gun Collective, LLC ("Company," "we," "us," or "our"), an Idaho limited liability company with its principal place of business at 784 S. Clearwater Loop, STE B, Post Falls, ID 83854.
These Terms constitute a legally binding agreement between you and the Company. We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email to registered users or through a notice on the Platform. Your continued use of the Platform after any such changes constitutes acceptance of the updated Terms.
02 // ELIGIBILITY
You must be at least 18 years of age to create an account or make purchases on the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.
Certain areas of the Platform that contain general informational content -- such as the shooting ranges directory, events calendar, and business listings -- may be accessed by users of any age without creating an account. Users under 18 may browse public informational content but may not create an account, post content, participate in community features, or make purchases.
03 // ACCOUNTS
To access certain features of the Platform, you must create an account. When registering, you agree to provide accurate, current, and complete information and to maintain and update this information as needed.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, contain false or misleading information, or are used for fraudulent or illegal purposes.
04 // SERVICES
The Platform provides the following services, which may be expanded or modified at our discretion:
User profiles, social feed, posts, comments, reactions, direct messaging, forums, live chat, follow system, reputation system, leaderboards, and the "Brass" virtual currency system.
Shooting ranges directory, gun shops and firearms businesses directory, business listings with claims and verification, and review system.
Events calendar with registration, event discovery by discipline and location, and organizer pages.
Firearms database, user reviews, shooter profiles, match scores, and scoring imports from recognized sanctioning bodies.
News aggregation, the Idaho handbook/wiki (collaborative), and editorial content.
A classified advertising venue where registered users may list firearms, ammunition, accessories, gear, and related items for sale, trade, or purchase. The Exchange is subject to additional terms set forth in Section 10 of these Terms.
Business claims and verification, advertising and sponsorship opportunities, and tiered business listing packages.
Digital subscription plans offering premium features and content access.
05 // CONTENT
"User Content" refers to any text, images, photographs, reviews, comments, posts, forum contributions, wiki edits, match results, or other materials you submit, post, or display on the Platform.
You retain ownership of your User Content. However, by submitting User Content to the Platform, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, display, distribute, and create derivative works from your User Content in connection with operating and promoting the Platform. This license continues even if you stop using the Platform, but only for content that has already been shared publicly or with other users.
You represent and warrant that you own or have the necessary rights to all User Content you submit and that your content does not violate any third party's intellectual property rights, privacy rights, or any applicable law.
You agree not to post or transmit User Content that:
We reserve the right, but are not obligated, to review, edit, or remove any User Content at our sole discretion and without notice. We may remove content that violates these Terms, is flagged by other users, or that we determine is otherwise objectionable or harmful to the Platform community.
We employ both automated and manual content moderation. Decisions regarding content removal are final, though users may appeal moderation decisions through our support system.
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been reproduced on the Platform in a way that constitutes infringement, please submit a DMCA takedown notice to:

Your notice must include: identification of the copyrighted work claimed to have been infringed, identification of the material to be removed with sufficient detail for us to locate it, your contact information, a statement that you have a good faith belief the use is not authorized, and a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
06 // PAYMENTS
The Platform offers digital subscription plans with varying feature access and pricing. Subscription details, pricing, and features are described on our pricing page and may be updated from time to time.
Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge your designated payment method on a recurring basis until you cancel.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be notified via email prior to any price increases.
We accept the following payment methods:
All credit and debit card transactions are processed by PCI-compliant third-party payment processors. We do not store your full credit card number on our servers.
Bitcoin payments are processed at the exchange rate at the time of transaction. Bitcoin payments are non-reversible by nature; refund requests for Bitcoin transactions will be evaluated on a case-by-case basis per our Refund Policy.
Prices displayed on the Platform do not include applicable sales tax unless otherwise stated. You are responsible for any applicable taxes associated with your purchases. We will collect and remit sales tax where required by law.
You may cancel your subscription at any time through your account settings or by contacting [email protected]. Upon cancellation, your subscription will remain active until the end of the current billing period. No partial refunds are issued for unused portions of a billing period unless otherwise specified in our Refund Policy.
07 // BUSINESS
Business owners may claim and manage their listings on the Platform. By claiming a business listing, you represent that you are authorized to act on behalf of that business. We reserve the right to verify business claims and may reject or remove listings that contain inaccurate information.
Advertising opportunities are available on the Platform through various packages and sponsorship levels. Advertisers are responsible for ensuring their ad content complies with all applicable laws and regulations, including the Federal Trade Commission's advertising guidelines.
We reserve the right to reject or remove any advertisement at our sole discretion, including ads that are misleading, promote illegal products or services, or are otherwise inconsistent with the Platform's standards.
Reviews on the Platform must reflect genuine experiences. Businesses may not post fake reviews, incentivize positive reviews, or retaliate against users who post negative reviews. We employ moderation to maintain review integrity and reserve the right to remove reviews that violate these standards.
08 // BRASS
The Platform features a virtual currency system called "Brass." Brass is earned through Platform participation -- including approved Exchange listings, community contributions, and other activities -- and may be used for designated purposes within the Platform. Brass has no cash value, cannot be exchanged for real currency, is non-transferable outside the Platform, and may be modified or discontinued at any time. Brass earned from any activity, including Exchange listings, does not constitute payment, compensation, or consideration for any transaction between users. Unused Brass is forfeited upon account termination.
09 // PROHIBITED

10 // EXCHANGE
The BGC Exchange ("Exchange") is a free consumer-to-consumer classifieds and auction-format listing venue for firearms, accessories, and related gear. The Exchange functions as a digital bulletin board. Boise Gun Collective, LLC is not a dealer, broker, escrow agent, auctioneer, or transaction facilitator. Every transaction conducted through the Exchange is exclusively between the listing party (seller) and the responding party (buyer). BGC is not a party to any such transaction.
BGC charges zero fees for any Exchange transaction. BGC's revenue is derived exclusively from business-to-business advertising subscriptions (MCC 7311), which are entirely separate from the Exchange. The Exchange is and will remain a free service.
BGC does not process, facilitate, hold, or escrow any payment between Exchange users. BGC does not ship, handle, inspect, appraise, or take physical possession of any item listed on the Exchange. BGC does not verify the identity, age, legal status, FFL status, or eligibility of any buyer or seller. BGC does not arrange or verify FFL transfers between parties.
Any representation by any user that BGC is a party to, guarantor of, or participant in any Exchange transaction is unauthorized and false.
Users of the Exchange are solely and exclusively responsible for compliance with all applicable law governing the sale, purchase, transfer, possession, and shipping of firearms, ammunition, and accessories. Applicable law includes but is not limited to:
BGC does not provide legal advice. Information displayed on the Platform regarding firearms laws or FFL requirements is for general reference only and may not reflect current law or apply to your specific situation. Consult a licensed attorney in your jurisdiction before completing any transaction.
By creating or responding to any Exchange listing, you represent and warrant that:
No Exchange listing may be designed to circumvent federal or state background check requirements. The following are strictly prohibited and will result in immediate account termination and referral to law enforcement:
As of the effective date of these Terms, the following states and jurisdictions require that all or most private-party firearms transfers be conducted through a licensed FFL with a background check:
California, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Maine (for certain sales), Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Virginia, and Washington.
Additional states may have enacted universal background check requirements after the effective date of these Terms. This list is provided for general reference only and does not constitute legal advice. It is your sole responsibility to determine and comply with the laws of your jurisdiction. Failure to comply with state background check requirements is a violation of these Terms and may constitute a criminal offense.
BGC reserves the right to remove any Exchange listing for any reason or no reason, at any time, without prior notice. BGC will cooperate with federal, state, and local law enforcement agencies, including responding to lawful subpoenas, court orders issued under 18 U.S.C. § 2703(d), and search warrants.
BGC may voluntarily disclose user information under the emergency exception provided by 18 U.S.C. § 2702(b)(8) of the Stored Communications Act where there is a reasonable belief that an emergency involving immediate danger of death or serious physical injury requires disclosure without delay. By using the Exchange, you acknowledge and consent to this cooperation.
The Exchange supports auction-format listings subject to the following terms:
BGC is a provider of an interactive computer service as defined by 47 U.S.C. § 230(f)(2). All Exchange listings, bids, messages, and user content published through the Exchange are information provided by third-party information content providers as defined by 47 U.S.C. § 230(f)(3).
BGC's provision of search, filter, category, location-based, messaging, and auction-format tools constitutes neutral tool functionality available equally to all users and does not constitute the creation or development of third-party content within the meaning of Section 230.
You must be at least 18 years of age to use the Exchange in any capacity. You must be at least 21 years of age to create, post, or respond to any listing involving a handgun or handgun ammunition, as required by 18 U.S.C. §§ 922(b)(1) and 922(x).
By using the Exchange, you represent and warrant that you meet the applicable age requirements for the specific items and activities you engage in. BGC does not independently verify the age of Exchange users.
All Exchange users must comply with the BGC Exchange Rules and Prohibited Items Policy, which is incorporated into these Terms by reference. The Exchange Rules document provides detailed guidance on permitted items, prohibited items, auction mechanics, FFL transfer requirements, and enforcement procedures.
11 // FIREARMS
The Platform provides information about shooting sports, firearms, businesses, events, and related topics for educational and community purposes. All information on the Platform regarding firearms laws, regulations, safety practices, or related topics is for general informational purposes only and does not constitute legal advice.
Users are responsible for understanding and complying with all applicable federal, state, and local laws regarding firearms ownership, possession, transfer, and use. Laws vary significantly between jurisdictions and are subject to change. When in doubt, consult a licensed attorney in your state.
12 // LINKS
The Platform may contain links to third-party websites, services, or content. We do not control, endorse, or assume responsibility for any third-party content or services. Your interactions with third-party services are governed by their respective terms and policies.
13 // PROPERTY
The Platform, including its design, code, graphics, logos, trademarks, and all content not contributed by users ("Company Content"), is owned by or licensed to Boise Gun Collective, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on Company Content without our express written consent.
"Boise Gun Club," the Boise Gun Club logo, and related marks are trademarks of Boise Gun Collective, LLC. You may not use our trademarks without prior written permission.
14 // DISCLAIMERS
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Platform, including business listings, event information, user reviews, or match scores.
Information regarding shooting ranges, firearms businesses, and events is provided as-is and may not reflect current operating hours, availability, pricing, or conditions. Users should verify information directly with the relevant business or organization.
15 // LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOISE GUN COLLECTIVE, LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
16 // INDEMNIFY
You agree to indemnify, defend, and hold harmless Boise Gun Collective, LLC, its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your User Content, or your violation of any rights of another.
Without limiting the foregoing, this indemnification obligation specifically includes any claim arising from your use of the Exchange, any listing you create or respond to, any transaction you enter into through the Exchange, your failure to comply with applicable firearms transfer laws, any misrepresentation in your GCA compliance acknowledgment under Section 10.4, or any injury, death, or property damage resulting from any item listed, sold, purchased, or transferred through the Exchange.
17 // DISPUTES
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions.
Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 60 days.
If informal resolution is unsuccessful, any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Ada County, Idaho. You consent to the personal jurisdiction of these courts.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
18 // TERMINATE
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 5.1 (license grant), 10, 14-17, and 19.
You may terminate your account at any time by contacting [email protected] or through your account settings.
19 // GENERAL
These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and Exchange Rules and Prohibited Items Policy, constitute the entire agreement between you and the Company regarding the Platform.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet disruptions, or other force majeure events.
