• •Background checks are mandatory. Buyers need either a handgun permit or a Firearms Purchaser Identification Card (FPIC)—both involve background checks AND fingerprinting. Selling without verification isn't just risky; it's a criminal violation, and "not knowing" won't hold up in court.

• •All sales go through an FFL. No exceptions. Every private sale must be conducted through a federally licensed dealer. The rule: "From FFL to FFL. No exceptions." This applies to in-state and out-of-state sales alike.

• •Out-of-state sales break federal law. Selling directly to someone outside New Jersey violates federal law. The only legal path: sell through an NJ FFL, who contacts an FFL in the buyer's state, and the buyer picks it up there.

• •You can't sell to certain people. Never sell to convicted felons or anyone with intent to harm others. For legal protection, document the buyer's stated reason for purchase.
