Brooke County Sheriff

The Brooke County Sheriff's office is the official point of contact for concealed pistol and revolver license applications in Brooke County. West Virginia law requires every county sheriff to accept and process concealed carry permit applications from county residents.

Application hours: - Tuesdays and Thursdays - 9:00 a.m. – 11:30 a.m. - 1:00 p.m. – 3:30 p.m.

You'll need to submit a notarized application with specific information:

• •Full name, date of birth, Social Security number
• •Valid driver's license or state photo ID showing your address
• •Physical description and place of birth
• •Citizenship information

Age & Eligibility: - Standard license: 21 years or older - Provisional license: 18-20 years old (valid until age 21)

Disqualifying Factors: You cannot get a permit if you have:

• •Felony convictions (unless expunged, set aside, or rights restored)
• •Misdemeanor crime of violence convictions in the past 5 years
• •Domestic violence convictions (any timeframe)
• •Current felony indictments or ongoing sentences/probation/parole
• •Domestic violence protective orders (emergency or final)
• •Mental incompetency adjudication or involuntary psychiatric commitment (without court order restoring rights)
• •Alcohol or drug addiction documented by treatment or multiple DUI/DWI convictions in past 3 years

You must complete a handgun safety and training course with live ammunition fired. Acceptable courses include:

• •National Rifle Association (NRA) official handgun safety or training courses
• •Law enforcement agency, community college, or private firearms training school courses with certified instructors
• •State or NRA-certified instructor courses
• •Military service (current or former) or National Guard/Reserve handgun qualification

Submit a photocopy of your certificate of completion, an affidavit from the instructor, or documentation showing successful completion. The document must include the instructor's name, signature, and NRA or state instructor ID number if applicable.

• •Tax Credit: You can claim a tax credit for training costs up to $50. If training was free or cost less than $50, apply that credit to application fees.

• •Processing Timeline: The sheriff has 45 days to issue, reissue, or deny your permit after all background checks complete.

The sheriff conducts a nationwide criminal background check including:

• •National Instant Criminal Background Check System (NICS)
• •West Virginia criminal history records
• •National Interstate Identification Index (NCIC)

No permit is issued unless the background check shows you're legally allowed to possess a firearm under state and federal law (18 U.S.C. §922(g) or (n)).

Your license includes: - Your full name and address - Your signature (signed in pen and ink) - Sheriff's signature and county seal - Wallet-sized duplicate card matching state ID standards (includes photograph as of July 1, 2017+) - Valid throughout West Virginia for 5 years - Allows you to carry concealed pistols or revolvers on any state lands or waters

• •If you move: Your license stays valid if you relocate within West Virginia. Notify the sheriff of your new county within 20 days and pay up to $5 for a license with updated address. Original expiration date stays the same.

• •If you lose your license: File a notarized statement with the sheriff's office. Cost: $5 for replacement.

If denied, the sheriff must state specific reasons in writing. You have 30 days to file a petition in circuit court for review. The court will determine if you meet the legal criteria. You can represent yourself or hire counsel (public counsel not provided). If you win on appeal, you may recover reasonable attorney fees and court costs.

All application information is confidential. Sheriffs cannot disclose applicant details except to: - Law enforcement (to verify license validity, assist criminal investigation, or for lawful law enforcement purposes)

Violating confidentiality is a misdemeanor ($50-$200 fine per offense).

Once issued, your concealed carry license authorizes you to carry a concealed pistol or revolver throughout West Virginia. The permit is valid for 5 years and can be renewed. Renewal applicants don't need to retake the training requirement—just apply and pay fees again.

Honorably retired law enforcement: You're exempt from all fees if you retired from WV-governed agencies under WV Code §7-14, §8-14, §15-2, or §20-7. All other requirements still apply.
